Welcome to Falconyte. These Terms of Service ("Terms") govern your use of our email marketing platform and related services (collectively, the "Service") operated by Falconyte ("us", "we", or "our").
By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service.
2. Accounts & Responsibilities
When you create an account with us, you must provide information that is accurate, complete, and current at all times. You are responsible for safeguarding the password and for all activities that occur under your account.
You agree to use the Service only for lawful purposes and in accordance with these Terms. You are responsible for ensuring that your use of the Service complies with all applicable laws and regulations, including but not limited to anti-spam laws and data protection regulations. 3. Payments & Subscriptions
Our Service is offered on a subscription basis. You will be charged in advance on a recurring basis. All fees are non-refundable except as required by law or as otherwise specified in our Refund Policy. New customers may be eligible for a 48-hour conditional refund under specific conditions outlined in our Refund Policy.
We reserve the right to change our pricing with 30 days' notice. Price changes will be communicated via email to your registered email address.
4. Refunds & Cancellation
You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of your current billing period. Canceling your subscription does not automatically entitle you to a refund. You will continue to have access to Falconyte's services until the end of the paid billing cycle. Refund eligibility is governed by our Refund Policy.
We reserve the right to suspend or terminate your account immediately if you violate these Terms or engage in fraudulent activity.
5. Intellectual Property
The Service and its original content, features, and functionality are and will remain the exclusive property of Falconyte and its licensors. The Service is protected by copyright, trademark, and other laws.
You retain ownership of any content you create or upload to the Service. By using the Service, you grant us a limited license to use, store, and process your content solely for the purpose of providing the Service to you.
6. Limitation of Liability
In no event shall Falconyte, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the Service.
Our total liability to you for any claims arising from or relating to these Terms or the Service shall not exceed the amount you paid us for the Service in the 12 months preceding the claim.
7. Termination
We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including without limitation if you breach the Terms.
Upon termination, your right to use the Service will cease immediately. All provisions of the Terms which by their nature should survive termination shall survive termination.
8. Governing Law & Contact Information
These Terms shall be interpreted and governed by the laws of the jurisdiction in which Falconyte operates, without regard to its conflict of law provisions.

Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect.
By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
